EPA tentatively denies petition to classify discarded PVC as hazardous waste

January 20, 2023

The U.S Environmental Protection Agency responded on January 12 to a rulemaking petition from the Center for Biological Diversity requesting discarded polyvinyl chloride (PVC) be listed as a hazardous waste under the Resource Conservation and Recovery Act. The EPA stated it is tentatively denying the petition.

PVC pipe is used extensively in the groundwater industry in wells and water distribution.

The EPA provided reasons for its denial in the Federal Register. The EPA is also currently soliciting public comment on the tentative denial. Comments are due to the EPA by February 13, 2023 and must be identified by Docket ID No. EPA-HQ-OLEM-2022-0971.
